General information on the rules regarding consent to the use of cookies

Italian legislation (in particular, art. 122 of Legislative Decree No. 196/03) has transposed into our legislation the EU legislation that requires the operators of websites that use cookies or other monitoring technologies to inform the user about the types of cookies used by the site and to request the prior consent of the same to send such cookies on the user’s terminal equipment and/or to access the information recorded therein.
The only exceptions to the request for consent are technical and/or analytics cookies with a low identification profile necessary (i) for the management of the site or (ii) for the provision of services expressly requested by the user, this also taking into account the provisions of EU Regulation 2016/679 of 27 April 2016 which, in Recital 26, provides that “The principles of data protection should apply to any information concerning an identified or identifiable natural person.” and that “Personal data which have undergone pseudonymization, which could be attributed to a natural person by the use of additional information should be considered to be information on an identifiable natural person.” (i.e. excluding so-called cookie analytics).

The Guarantor for the protection of personal data then intervened with the provision on “Identification of simplified methods for the information and acquisition of consent for the use of cookies” of 8 May 2014 (published in the Official Gazette no. 126 of 3 June 2014).
EU Regulation 2016/679 of 27 April 2016, in Recital 30, also provided that “Natural persons may be associated with online identifiers provided by their devices, applications, tools, and protocols, such as internet protocol addresses, cookie identifiers or other identifiers such as radio frequency identification tags. This may leave traces which, in particular when combined with unique identifiers and other information received by the servers, may be used to create profiles of the natural persons and identify them.”.

Pursuant to and for the effects of current legislation on the processing of personal data (EU Regulation 679/2016 and Legislative Decree no. 196/2003), we inform the user that the Data Controller is Lekkerland Italia s.r.l.
